Product Liability Notice
By purchasing and using any MS Bats product, the buyer acknowledges that the use of wooden baseball bats carries inherent risks, including potential breakage and injury. The purchaser assumes all risks associated with use. To the fullest extent permitted by Maryland and federal law, MS Bats shall not be liable for any injuries, damages, or losses resulting from the use or misuse of its products.
Limited Warranty
MS Bats warrants to the original purchaser that its bats are free from defects in materials and workmanship under normal, intended use for thirty (30) days from the date of receipt.
Covered
- Breakage or failure due to a manufacturer defect during normal, intended use with regulation leather baseballs.
Not Covered
The warranty does not cover failures, damage, or breakage caused by:
- Hitting anything other than a regulation leather baseball (e.g., dimpled balls, soft toss with non-leather balls, striking the ground, fence, rocks, or other objects).
- Contact outside of the sweet spot, particularly below the logo or off the end of the barrel.
- Repeated contact on the bat’s weak side.
- Cosmetic issues or a cracked, chipped or dented cup that does not affect the structural integrity or performance.
- Use by anyone other than the intended user or for purposes other than baseball.
- Abuse, misuse, alteration, improper storage, or improper maintenance.
Exclusive Remedy
At MS Bats’ sole discretion, an eligible claim may result in:
- Repair of the bat,
- Replacement with a comparable product, or
- Store credit.
How to File a Claim
- Email [email protected] “Warranty” in the subject line within 30 days of receipt.
- Include proof of purchase and clear photographs of the bat and damage.
- In some cases, MS Bats may require the bat be returned for inspection.
- The customer is responsible for all return shipping costs.
- Instructions will be provided if return is necessary.
Additional Terms
- This warranty applies only to the original purchaser and is not transferable.
- MS Bats makes no other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose, except as required by Maryland law.
- Some jurisdictions, including Maryland, may not allow limitations on implied warranties or the exclusion/limitation of certain damages; therefore, parts of this warranty may not apply to you.
- This limited warranty provides specific legal rights; you may also have additional rights under Maryland law.
